US Court finds dismisses complaint against Turnitin
Saturday, 29 March 2008
In an extremely questionable decision which seems to contain many grounds for appeal, the US Federal District Court (for the Eastern District of Virginia) has dismissed an action brought by high school students against iParadigms, A California corporation that operates the highly controversial plagiarism-detection system turnitin.
The action was brought by high school students against iParadigms alleging copyright infringement. In its 24 page ruling, the court upheld a waiver of liability clause in the click-wrap agreement that barred the suit and went on to say that even if the action had not been barred the defendant's use of the students' work constituted fair-dealing because of its highly transformative nature.
